Terms of Service

1. General

These Terms of Use (“Terms”) are a legally binding agreement between Game Story Gaming Ltd. and its affiliates (“Game Story”, “we”, “our” or “us”) and you. They govern your use of the features, content and services Game Story provides, including the website and its gaming applications (together, the “Services”).

By registering, participating in competitions or using the Services, you agree to these Terms, the Privacy Policy and the applicable Rules, which are incorporated by reference. If you do not agree, do not access or use the Services.

2. Changes to Terms or Services; Rules

Game Story may revise, modify or terminate these Terms or any part of the Services at its discretion. Updated terms may be posted on the Services or sent to the email address associated with your account and will take effect when posted or on the date specified in the notice. Continued use means acceptance of the updated Terms.

Game Story may publish additional rules and policies for particular games, competitions, promotions, tournaments, payments, withdrawals or other features. References to these Terms include those Rules. Services and features may change, be suspended or discontinued, and availability may be limited by user, area or jurisdiction.

3. Skill Games

Games, tournaments, contests and competitions offered through the Services are intended to be games of skill. Results are determined by objective criteria and sufficient player skill as described in the applicable Rules and laws. Game Story does not offer gambling. You use the Services for entertainment and not as a business or for gambling purposes; ongoing victories are not assured.

Game Story uses skill matching to pair competitors. See Section 12 for more information.

4. Registration

Some features require an account. Each person may establish, maintain and control only one account. Game Story may request personal information or documents, including proof of identity, age or address, as a condition of access or withdrawal. Such information is handled under the Privacy Policy.

You agree to provide accurate, complete and current contact and payment details and to keep your account secure. You are responsible for activity under your account and must promptly report suspected unauthorized access. Accounts and competition prizes are not transferable except as required by law.

5. Eligibility to Use the Services

You must be a natural person who meets the minimum age requirement (at least 18 or the applicable age of majority), control the email address used to register, have legal capacity to contract, be located where use is permitted, and comply with these Terms. Game Story may ask for proof of registration information and may terminate accounts or withhold funds where permitted if requirements are not met.

6. Compliance with Laws and Regulations

Use of the Services may be subject to local rules governing contests, sweepstakes or tournaments with fees or prizes. You are responsible for determining whether use is lawful where you are located. Game Story identifies Arizona, Iowa, Louisiana and South Carolina as states that prohibit or may prohibit access; for card-based games, Indiana, Maine and Montana may also be restricted. Game Story may update restrictions and block access by location.

You must comply with applicable export and sanctions laws and must not access or use the Services from prohibited jurisdictions or if you are a prohibited person. Game Story may monitor interactions with the Services as permitted by law.

7. Prohibited Uses

You may use the Services only for lawful purposes. You may not upload or distribute unlawful, harmful, deceptive, abusive or infringing content; violate another person’s rights; interfere with the Services; introduce malicious code; scrape or access the Services through automated systems; impersonate another person; or remove proprietary notices.

Unfair participation includes using multiple accounts, buying or selling accounts, giving another person access, using unapproved software, collusion, dishonest play or fraud. Game Story may suspend or terminate accounts and forfeit prizes or balances for prohibited conduct, subject to applicable law.

8. License and Restrictions

While you comply with these Terms, Game Story grants you a limited, personal, non-exclusive, non-transferable and non-sublicensable license to use the Services for your personal, non-commercial purposes. You may not copy, modify, distribute, sublicense, lease, lend, rent, reverse engineer, decompile or disassemble the Services.

9. Payments and Winnings

Fees for activities are disclosed before entry and are generally non-refundable unless stated otherwise. You authorize charges for fees you incur and agree to provide accurate payment information. Notify Game Story of billing errors within 30 days. Deposits and withdrawals may require identity verification and may involve third-party processing fees.

Bonuses may be subject to conditions and may not be withdrawn. Withdrawals may take up to 90 days and can be delayed for investigations or legal compliance. Cash prizes must generally be claimed within 60 days. You are responsible for taxes on prizes and winnings. Competition cancellations and refunds are handled under the relevant Rules.

10. Intellectual Property Rights and DMCA Notification

Game Story and its licensors own rights in the Services, including text, images, graphics, trademarks, brands, videos, music, logos and designs. You may not reproduce, publish or use those materials without permission. Feedback you submit may be used by Game Story under a worldwide, perpetual, royalty-free license. Game Story responds to infringement notices under applicable copyright laws and may terminate repeat infringers.

11. Virtual Items

Virtual items and currencies are licensed for personal use within the Services. They have no real-world cash value, cannot be cashed out, and may not be transferred, sold or exchanged outside the Services. Licenses are non-refundable and may be removed, modified or forfeited if an account is suspended or terminated or the Services are discontinued.

12. Skill Matching

Game Story matches players using game-specific skill levels that may reflect contest type, difficulty, experience, scores, past performance and entry fees. Players may not have exactly the same skill level. In some cases, the system may use a historical score from another real opponent. Winning depends on whether your score exceeds your opponent’s score.

13. Third Party Websites and Links

The Services may link to third-party websites or applications, including promotional offers. Game Story does not control or endorse those services and is not responsible for their content, terms, privacy practices or charges. Your dealings with third parties are your responsibility. Additional terms may apply when using the Services through Apple’s App Store.

14. Disclaimers

You use the Services at your own risk. The Services are provided “as is” and “as available”, without warranties, including warranties of merchantability, fitness for a particular purpose or non-infringement. Game Story does not guarantee uninterrupted, secure or error-free operation, specific results or profits. Some jurisdictions do not allow certain warranty exclusions, so these limits apply only to the extent permitted by law.

15. Indemnification and Limitation of Liability

You agree to indemnify Game Story and its affiliates and representatives from claims and expenses arising from your access to or use of the Services, your content, infringement of another person’s rights, interactions with other users or violation of these Terms or applicable law.

To the maximum extent permitted by law, Game Story is not liable for indirect, incidental, special, consequential or punitive damages, lost profits, data or goodwill, service interruptions, third-party conduct or unauthorized access. These limitations do not restrict liability where applicable law prohibits such limits.

16. Agreement to Arbitration and Class Action Waiver

Please read this section carefully. It affects your right to bring claims in court.

You and Game Story will first attempt to resolve disputes informally for 60 days after written notice. Unresolved disputes are generally subject to binding arbitration. U.S. residents are subject to the Federal Arbitration Act and arbitration administered by National Arbitration and Mediation; for residents outside the U.S., the applicable Israeli arbitration law and ICC Rules apply. The hearing location is New York City for U.S. residents and Tel Aviv for non-U.S. residents, unless otherwise agreed.

Claims must generally be brought individually, not as class or representative actions. An opt-out notice may be sent to support@gmstry.com within 30 days of first use or the effective date of a materially changed arbitration clause. The Terms describe exceptions for intellectual property and eligible small-claims matters and additional procedures.

17. Termination and Closing Accounts; Inactive Accounts

Game Story may limit, suspend or terminate an account or access to the Services if it believes you breached these Terms, present a legal risk, are delinquent, infringe rights or engage in fraudulent or illegal activity. Closing an account may forfeit account amounts unless withdrawal was requested beforehand. Accounts with no competition or tournament entry for six consecutive months may be treated as inactive; accounts inactive for 12 months or more may be terminated. Maintenance fees may apply under posted policies.

18. Governing Law

For U.S. residents, New York law governs and courts in New York County have jurisdiction for disputes not subject to arbitration. For others, Israeli law governs and the courts of Tel Aviv have jurisdiction, subject to the arbitration terms above.

19. Assignment

Game Story may assign or delegate its rights or obligations. You may not assign or delegate your rights or obligations without Game Story’s written consent.

20. Notices

Game Story may contact you by email, mail, telephone, through the Apps or by notices on the Services. Keep your contact information current. Legal notices to Game Story should be sent using the contact details below.

21. Merger and Severability

These Terms are the entire agreement between you and Game Story about the Services. If any provision is found unenforceable, it will be limited only to the extent of the ruling and the remaining provisions will continue in force.

22. Survival

Terms that by their nature should survive account termination will remain effective, including provisions regarding changes, compliance, prohibited uses, payments, intellectual property, disclaimers, liability, arbitration, governing law and termination.

23. Language

These Terms and related documents were prepared in English. If translated, the English text controls in the event of a discrepancy.

25. Text Messages and Automated Calls

Providing a phone number to Game Story, including in an account profile or Website contact form, does not by itself enroll you in promotional text messages or authorize automated marketing calls. We may send transactional texts when you request or enable the related service or when otherwise permitted by law. We send marketing texts only after a separate, affirmative opt-in. Transactional and marketing choices are presented separately when both are offered. Your consent to marketing calls or texts is not a condition of purchasing goods or services. Where applicable law requires prior express written consent, we obtain and retain that consent through the separate sign-up flow. The sign-up disclosure identifies Game Story, describes the program and message purpose, and states that message frequency varies.

The following consent statement applies only when you separately select a text-message opt-in; accepting these Terms alone does not enroll you in text messages.

You agree to receive marketing and/or account notification messages from Game Story. Message frequency varies. Message and data rates may apply. For help, reply HELP or email support@gmstry.com. To opt out, reply STOP at any time. We honor opt-out requests within the time required by applicable law. Any opt-out confirmation will only confirm your request and will not contain marketing. Text delivery depends on your carrier and network and is not guaranteed; carriers are not responsible for delayed or undelivered messages.
